Perhaps one of the more challenging questions a traveler must answer is what bare medical necessities to bring, for instance, generic for mevacor. The Federal Court of Australia recently overturned a decision of the Patent Office rejecting an application for an extension of patent term, and in doing so effectively extended the definition of "pharmaceutical substance" under Australian patent law, bringing with it implications for patent extension of term applications. The application was accepted by the Australian Patent Office on 6 July 2000. Lovastatin, the subject of the patent, is contained in the product Mevzcor used for the treatment of high cholesterol levels. Lovastatin is present in Mevacor as a pro-drug which is converted into an active metabolite, the beta-hydroxy form of lovastatin, following administration. The accepted claims of the patent referred specifically to the beta-hydroxy form rather than to lovastatin as it is present in Mevacor. Opposition before the Patent Office Arrow Pharmaceuticals, a generic pharmaceutical manufacturer, opposed the application for an extension of term of the patent on 27 October 2000. This has, to date, been the only opposition to an application for extension of patent term in Australia. Amongst other grounds, Arrow argued that lovastatin, which is administered in the form of a prodrug, did not "in substance fall within the scope of a claim of the patent" as required by the Act, as the patent claims are directed to the active beta-hydroxy metabolite. In the alternative, Arrow also argued that if the "pharmaceutical substance" relied on to extend the patent term was in fact the metabolite, then this was not contained within the goods included in the ARTG. The opposition to the extension of term was successful and rizatriptan.
